The Constitution vs the health care bill
Synopsis:
All the talk is about having to pay a tax if you do not buy a government specified insurance plan, that it is unconstitutional. The danger everyone needs to realize is that you are being forced to buy and USE the insurance. This would set the precedent that government can force you to buy and USE whatever the government legislates.
Let's first get rid of some minor arguments.
One argument for the mandatory health care tax:
"It is mandatory that everyone have auto insurance."
No, it isn't.
If you only have a bicycle, you don't buy auto insurance.
You can go into any car dealership (that is still in business) and, with cash, you can buy a car. If you intend to use the car on public roads, then you are required to have insurance.
If you intend to use a car for show and never drive it, for example, an original Bumblebee Camero used in the filming of the Transformer movies, do you need auto insurance or would you want a special policy tailored just for you?
Another argument used to justify taxing our lives:
"Uninsured people might get sick or hurt and then use emergency services they haven't paid for."
1. Yes, and, if they live, they will later get a job and pay for insurance they may not use for the rest of their lives. If they don't get a job, they get to make payments to the hospital.
This is a risk insurance companies will have to take, but then, they are experienced in that.
2. Since we all might get sick or hurt and the government mandates we be covered, we must have insurance that will certainly pay for the maximum expected costs.
Everyone should be required to buy a multi-million dollar insurance package.
3. This is a tax on the individual. The family is not relevant.
All children, including orphans and abandoned children, should get a job. Failure to pay is a trip to a working reform school.
Because the penalty is a tax, child labor laws do not apply.
4. One more argument against: We give billions in aid to other countries ...

We now need to introduce this "imaginary" situation.
Suppose someone gets hurt enough to go to the hospital. Suppose also that they are unhappy. They had to buy a government mandated insurance policy. Having to increase their student loan to pay for the extra semester, they're told the higher interest rate payment is to pay back China for the principle and most of the rest has nothing to do with education. This person goes to the hospital and decides not to use the insurance - they declare themselves a John Doe.
The government mandated a tax if you do not buy insurance. Is there no tax on not using the insurance?
The insurance was paid for, commerce was achieved. Do the government overlords care if the insurance is used?
If we all are supposed to have insurance and some don't, will the hospital turn away those without?
To keep this situation from happening, a couple of additional items will get legislated:
1: Identification will have to be absolutely obtainable. Personal choice must give way to social needs. Fingerprinting, an ID chip under the skin, or some other method will have to be implemented on all citizens.
2: Hospitals will be required to turn away people without insurance.
We'll see how long it takes liberals to work on both of these.
The point of this discussion: the intent of the mandated tax is that you must purchase and USE health insurance.

And now, the main event: why the health care bill is unconstitutional.
For this we bring out the words of our Constitution:
"Section 8 - Powers of Congress"
"To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes;"
If there is commerce, then congress can regulate it.
Democrats have forced a law that binds us to the purchase and USE of a product that doesn't exist.
We will be taxed if we do not purchase a government-specified insurance plan, a plan does not yet exist. Democrats have passed a law that requires us to buy something we will not see for years.
If declared to be constitutional, promoting the general welfare, here are a few other items. They don't exist but will be good for the country, thus you will be taxed if you disobey:
You will purchase and wear a 3d virtual reality helmet that displays
michael moore videos and al gore speeches in a continuous loop.
Social conscience is good for you and the country.
You will purchase and have put under your children's skin a chip that will
provide a shock whenever the child speaks a profanity.
The success of the child-chip (over 75% against) inspires another law in which you purchase and have put under your skin a similar chip. A newly discovered feature is that this chip transmits a signal should you speak a word from a programmable list.
The idea of such things, and the idea of paying for them until they exist, screams that this is against the Constitutional acknowledgement of our right to Life, Liberty, and our Pursuit of Happiness.
FORCING THE PURCHASE OF SOMETHING THAT DOES NOT EXIST IS AN ATTEMPT TO CREATE COMMERCE.
FORCING US TO PURCHASE AND USE SOMETHING THAT WILL BE DEFINED AT THE FUTURE WHIM OF GOVERNMENT IS OPPRESSION.
CONGRESS DOES NOT HAVE THE RIGHT TO FORCE AN INDIVIDUAL TO CREATE COMMERCE.

What about items that do exist?
If the mandated tax in the health care bill is declared constitutional, congress can require us to purchase anything they choose. What may be worse is that congress can requires us to USE whatever they choose. They think that making it a tax issue can nullify our right to Life, Liberty, and our Pursuit of Happiness.
Life:
You must purchase and USE pregnancy prevention items.
Liberty:
You must purchase and use mileage regulators in all cars.
The Pursuit of Happiness:
You must purchase and use specified aptitude tests to determine the schools the government=issued student loan will allow on your application.
Congress does not have any right to require me to purchase and use any item just because Congress wants it to happen.
Congress does not have any right to require me to purchase and use a GM car.
Congress does not have any right to require my wife to purchase and use lead-contaminated items from China.
FORCING THE PURCHASE OF AN EXISTING ITEM IS AN ATTEMPT TO INITIATE COMMERCE.
FORCING US TO PURCHASE AND USE AN ITEM BECAUSE GOVERNMENT DESIRES IT IS OPPRESSION.
CONGRESS DOES NOT HAVE THE RIGHT TO FORCE AN INDIVIDUAL TO INITIATE COMMERCE.
CONGRESS DOES NOT HAVE THE RIGHT TO TAX AN INDIVIDUAL UNLESS THE INDIVIDUAL INITIATES COMMERCE.

A government specified health plan should cost the same for everyone.
If someone pays significantly more than another for a government mandated requirement, just because of a 30 year difference in age, that is is age discrimination.

A newly born child not covered by health insurance must pay a tax. The parents are responsible for having the money. Any individual that does not pay the tax is subject to a fine and/or imprisonment.
For everyone in the country this means our fundamental needs of food, clothing, and shelter have been legislated to be secondary. Before anything else, money must be used to buy insurance, or pay the tax, or pay the fine.
This does not promote the welfare of the country, but it will put some on welfare..
For those who have little money, it is the food, the clothing, the decent place to live that will be sacrificed because of the health care bill. The welfare of the family is degraded; the "Blessings of Liberty" are sucked away by the IRS.
I'm reminded of farmers, in lands across the ocean, in a time not long ago, who had to turn over the bulk of their crop to pay the government tax, leaving little to use for sale or feed their families.

Democrats did not want insurance companies to sell across state lines. If enabled, the tax on mandatory insurance would be unconstitutional.
Also in the Constitution:
"No Preference shall be given by any Regulation of Commerce or Revenue to the Ports of one State over those of another: nor shall Vessels bound to, or from, one State, be obliged to enter, clear, or pay Duties in another."
Again, if insurance companies crossed state lines, earmarks, backroom deals, made by democrats favoring their states, would be unconstitutional.

The health care bill protest
The tea party people voluntarily came from many states to let congress know the bill is bad for the country.
I was there yesterday - count thousands, from Virginia, Maryland, the Carolinas, Florida, Oklahoma, New Jersey, New York. West Virginia, more.
The press pumps up reported actions having no evidence and ignores the thousands who know the truth.
Yes, there are many older people. That's because they were educated with the real history of the country, They care for the country, for their children, grandchildren, friends and family.
There were also just as many younger Americans. One very young child held up their sign: "Where's My Free Pony?".
Remember the Olympic skater who lost the gold medal because of his coach? The dem leadership has gotten in front of congress and is telling them to change lanes at the end.
The average american isn't stupid, but they are also do not know what's going on. Their news is filtered by the narcissistic press and entertainers, entities that are failing the country.

The Tea Party Will Win
We believe in the Constitution, are followers of the founding fathers, and look to their words in our fight for freedom.
Those who created the Constitution did their best that it should be a lasting document, but since it was the first of its kind, they would in their time be yet uncertain.
We believe in the Constitution, a belief forged by an advantage the founding fathers did not have. We were educated in the Constitution from the beginning. Our parents were. Our grandparents were.
Our world has over 200 years experience where the Constitution stood strong. The Constitution was the seed of the the greatest nation ever seen, the Constitution stood against evils which tried to encompass the world.
The Tea Partiers require only the founding documents: The Declaration of Independence, The Preamble, The Constitution, The Bill of Rights. The ink on them has been dry for a long time. The heart of them lives, and always will.

The tea parties. Are they important? Do they have a future?
Washington, DC, 9/11/2009. Washington, DC, 11/5/2009. We were there.
Thousands of people facing the Capital, a population spreading out into the National Mall, 9/12/2009. They came from everywhere - from other states, from other economic levels, from other histories. I was surrounded by thousands of people, but not concerned about it. Inside each was a little piece of star-spangled flag.
Politicians have listened to the sounds of the crowd and do not understand. The sound in the air is what it sounds like when you've hit bedrock.
The tea parties are not just those who came. The parties include those many more who could not come. The two groups combined to inform congress on what the country supports and what it does not.
Now, those thousands are considered as one entity - the Tea Party. It has brought in new governors, stopped bad legislation, re-educated congress, got a communist out of the administration, bucked the senate and house leaders who think they have absolute power, and convinced poor representatives to flee.
Now, there are those who want the Party to continue and those who want it to go away.
We've established here, by the results listed, that the Tea Party is important. When democrats were looking to surge against the country, and republicans were dazed in their powerlessness, the people of the parties renewed their education (with the great aid of Fox) and rose up.
They rose up, like Poseidon out of the sea, that the ship of state would know the real nature of the ocean it rides upon.
Does the Tea Party have a future? Will it go away? The answers are in short and long term statements of the tea partiers, statements they may not yet have realized.
The short term statement has a list of what we are fighting against now: stoppage of spending, no bills that try to hide it, national security, support of our allies, all the other items we are well aware of. It condenses to this: we know what will help the nation - government should get back to it.
The question about the future. People are wondering if the Tea Party will be a third party, will merge into the GOP, or will dissipate. The Tea Party is not an ordinary political party. It is the result of these times and of our education in the real history of the country.
The long term statement of the Tea Party has arrived.

Communism - the political theology in which property is owned by the government, because the government knows what is best for everyone. Under communism everything is property, including the people. Communism advertises a classless society. The reality is that it breaks down a country until there are only two classes: those in the government and those who are not.
In China, under Mao, many objected and died for it, about a million people. Another million objected, and died. Another, and another. Ten million. Twenty million. Thirty million. More.
Communist Russia and China tried for years to spread Communism by support of forces and regimes in other countries. It has cost thousands of American lives and the lives of its allies, fighting against the forced subjugation of the world. The adamant stand in the Reagan era helped to bring an end to Communist Russia, freeing millions in Eastern Europe, freeing the world from the Russian threat. Communists today, in smaller, weaker countries, continue to terrorize the people.
The executive office of our country carries the power authorized by the Constitution, power that is added to by various supreme court verdicts. Orders and edicts from the office carry the power of the executive.
If there is one thing historians will note about the year 2009, it is that the administration hired an avowed communist.

Ann McElhinney spoke in a panel at CPAC 2010.
I hadn't any experience seeing her before. She's quite a firebrand, and extremely engaging with her manner of presentation. I do recommend her talk at CPAC. If you know of other speeches she has done, leave a note.
She started with commentary on Cameron's movie - Avatar. Her estimation was that it was beautiful, and also absolutely anti-american, anti-capitalist, and anti-mining. She disliked that every child wants to see it and thus will be brainwashed.
I disagree, so I'll pen on.
I haven't listened to or read any any Cameron interviews relating to his politics. Not really interested; thought I'd let the movie work it. I'll write here about what I saw.
Anti-american - no. The people of Pandora have their freedom. The company will provide for the greater good of the universe, which requires forcing the tribe's relocation to a relative desert. The people in the movie theatre don't like that. Was "Mao" the head managers middle name?
Anti-capitalist - no. The mining company wasn't doing resource development. They were after resource stealing. They never cared to understand what was all around them. Everyone in the theatre realized there were amazing possibilities on that planet. Capitalism rules.
Anti-mining - what mining? What I saw was Blitzkrieg.
So, what was in this movie? Does this sound familiar to you?
1. Deciding they want the wealth of another population an organization activates a public plan. Should the plan fail, they have a plan b.
2. Negotiating with the population while, behind the scenes, readying an army that will enforce control.
2. The use of science so long as it is working for them. When the science will expose they are wrong, they cut off direct access to the data and the scientists, instead interpreting findings which happen to filter down to exactly what they want to do.
3. Justifying their actions with claims of the greater need.
4. Attempts to silence opposing scientists by ending their careers.
5. Belittling and demonizing the population they want to silence and push aside.

Yes, children are going to see it, but hopefully every child, and every one of us, is going to feel it.

The democrats, ignoring the decision of a great majority that the health care bill is bad, displayed for the country their absence of ethics. They must have the studied the corporation in Avatar, on how to justify behavior. It is a corporation that is bigger than the banks, the car companies, etc.
If Cameron intended the film to promote global warming and all the other liberal bullying then he made a big, expensive mistake. The film screams Freedom and Self-Reliance. The entity that is the corporation is an avatar itself, encapsulating the real mindset of the liberal progressives.
Avatar: a space-age corporation invades a planet, that is hundreds of years younger, to lead the population on how to use the resources of their planet for their own good.

The next crisis in global warming
Scientists in many countries have irrefutable evidence confirming the sun is causing water to be taken from the worlds oceans. This undeniable fact has a direct effect on climate change.
Our responsibility for this is without question. We must provide reparations to the affected countries of the world, supplying minimum dollar amounts to those with acreage at the earth's poles to a maximum for countries at the equatorial latitudes.
We must act to address this global situation. We need a program to exinguish the sun. We need it now.

health care summit- On the Record w/ Greta Van Susteren 2/26/2010
I just want to say how excellent the show was.
I wasn't able to watch the summit, being a working guy, and so listened to various commentary afterwards, from Levine, OReilly, Hannity. It was all kind of the same.
Then came On the Record. The introductory piece, and then the interviews, opened up more about what went on and the ramifications.
I was reminded of the time in the Civil War, when there was no fighting. The lines were close enough; men from both side would meet and exchange coffee, tobacco, etc. Though at war, it was an indication that, down at the level of the people, there would be a future.
Thanks to Miss Van Susteren for the fine journalism.

health care - one statistic that is half-full
Data collected from insurance companies calculates that almost 50% of our health care is spent over the age of 65. Progressive democrats announce this, pushing national health care on the country, trying to to convince us we'll have to accept age-related reduced authorizations when the program takes effect.
Again - 50% of our health care - spent when we are over 65.
This is a great statistic. This is what we want to see.
Why should we want the opposite: to have poor health our entire life and then die young? There's a term for that; it's called "third world country".
But no, the progressives want laws establishing, if you survive the world long enough, you will be punished for it.
Americans have the right to live. Friends and family pass on, the world changes. Younger Americans need real sources for the history of their country.
We want the medical community to advance. We want to have that '65' number pushed higher. We want medical finds turning into more years of better health. This is the progress the progressives would kill.

Progressive governing
In 2009 the Communications Director said that Mao Zedong, the communist murderer, is one of the major "philosophers" she turns to for guidance. Other progressives in the administration also have the same high opinion of Zedong and his works.
What are the the lessons to be learned, what guidance is achieved on governing? Perhaps we can gain insight by looking at this communist leader and his relationship to the people of his land.
In the Chinese civil war Zedong was losing. Zedong turned the massive peasantry away from the non-communist party with the promise of land "reform". When Zedong is the leader the farmers will take the land from the rich landlords. This persuasion gave Zedong an added army of over five million, overwhelming the opposition and putting the communist party in total control of the country.
Zedong finally had the power. Promises were forgotten. The communist government took the land. The farmers got a country full of tyrants.

2010: winter does not rhyme with copenhagen
It is winter in the Northeast; the beginning of a year that will be remembered by just one word: snow. Through the nonstop work of the hired plows, every parking lot has five to ten foot tall replicas of the Himalayas.
Three to four feet of the white ice surrounds our house. In the back stands a fifty foot tall Atlantic White Cedar. The weight of snow and the force of the winds on a large limb, that had extended from halfway up the trunk, ripped the limb off. It now stands alone, upside down in the snow, its bare, broken, end ten feet up in the cold air. It will be a while before I can deal with it, so great, the neighbors are going to think I don't know how to plant a tree.
Everyone is tired and cranky from hours of clearing off steps, driveways, sidewalks. We could not wait days for the snowfall to end, but had to go out to stay up with the amounts, venturing when the snowfall was light. I did go out to the street during the blizzard. A cold hard wind drove the air, not letting the snow easily reach the ground, turning dark into white. Take my advice - always take a portable gps and cell phone.

Clear a path on the deck, push the pile of snow off the lounge chair, lay back and relax with hot chocolate, catch up on the latest issue of Tan and Frostbite.

Today's news flash:
We have learned that, thanks to fine reporting by NoNewsYouLose.con, water-boarding has been reinstated, with some modifications.
The use of water has been prohibited. The approved replacement substance is generally identified as "air". It is retrieved from the best high mountain ranges.
Shopping mall management has promoted injecting specific chemicals into the air flow systems to make customers feel happier and secure, encouraging continuation of the shopping experience. The approved interrogation air is similarly modified, using additives supplied by the democratic party Department of Speeches and Conventions.
To increase the interrogation experience an additional modification has been implemented. The specific additive used for males is referred to as the "Larry King" formula.

global warming meets health care
Global warming proponents claim excessive human output of CO2 is endangering the climate. It is their justification to begin enforced population control.
Just how much CO2 can the tiny little lungs of new babies emit into the atmosphere? Upon birth the newborns are kept sedated, locked away in sealed environments. In hundreds of hospitals across the nation, in large rooms full of newborn babes, not a single attending nurse has ever fallen over from asphyxiation.
There is a much larger source of CO2. unreported, widespread, which should be stopped, for immediate relief to the people and animals of the country: fitness centers.
These locations are dedicated to increasing the expiration of millions of Americans, pumping millions of gallons of CO2 into the air, causing victims to seek relief in sugary drinks and chocolate ice cream, causing the sky to go dark each night.
We need to get these centers of atmospheric poison under control by passing legislation that will restrict breathing rates to government established norms. With such laws, showing our commitment to saving the world, we also won't have to hear about sport figures getting millions of dollars, because we just wiped out their livelihood.

Some commentators have referred to the the heads of the house and senate as "princess" and "prince". These terms are just references to their self perception and the attitudes they display towards those they rule.
Because some do object to this practice, perhaps we should see about using some other rule of construct, such as by current status and achievement.

health care - a letter to each member of congress
I'm asking you to defeat the health care bill.
You already know the country can't pay for it; trying to will continue to smother our economic recovery.
If signed into law, for all the years following it won't be known as the Obama Health Care Bill. In your state it will be called the YOURNAME-Obama Health Care Bill.
Claims are that the price is under the $900 billion target. That's like bragging you got a car salesman to under $60000, knowing that you can't pay $6.
When you have to work so hard to create new taxes on every facet of American life, it's an indication you can't pay for your program.
The recent mammography announcement brought out a backlash. With the public option, the government can enforce these kinds of decisions onto everyone. The backlash will manifest on election day.
The first four years of this bill is a collection of billions in taxes that will be washed away in the tax revenue spending, just like the social security collections.
Those who really need the health care still wont have it. The lives of many senior citizens will be paralyzed. All Americans will be taxed to deliberately kill babies throughout the country.
This thing is going to suck money and lives like a Sham Wow sucks root beer.

Instead of improving health, it will cripple the nation. It must be defeated.
This bill is being pushed by democrats trying to get it through before the country can fully know what it will do to them.

by the congress that authorized the taking; both will be used against us.
This bill will create newly hired bureaucratic populations exercising government
oversight in every state, in every town. Our income will be taken for their paychecks so they can directly interfere with our lives, with nothing for us but restrictions or fines.
It is all about what we can't do, unless we get government approval.
If enacted, we would be breaking the law for attempting to pay a doctor who is outside the government specified healthcare parameters.
It will make illegal our right to choose legitimate professionals for ourselves and our families.

Newspapers, magazines, tv channels, all award themselves in their fine performance of journalism. It is true, that they are being journalists, working to bring us news. We like their news. We like it because we have liked it before.
Think back, to elementary school. There was an item I always looked forward to reading. One of my favorite reads, it was informative, I liked to read, and it was understandable. There was news made for me, which I now know was tailored for my grade level.
It was the Scholastic Weekly Reader, still a value to elementary education.
News editors, publishers, producers, journalists, can keep control of the country from the public, and still insure everyone gets an education.

democrats mislead the nation
Democrats say they inherited the problems of the previous administration, that their lack of results is because they "didn't know the problems were so bad".
They don't mind fixing the problems they inherited, but those who made them should shut up about the spending of millions of dollars and not seeing any results.
One would think by now people would have seen through this.
The democrats did not "inherit" the problems - they asked for them.
That's what a campaign is. You let the people see that you know what their problems are.
You ask that they give their problems to you by voting for you.
You show the voters you know how to fix the problems, how to make their lives better.
In a campaign you give the voters the details on how you will fix the problems,
because you are supposed to know this before getting elected.
They don't mind fixing the problems they inherited, but those who made them should shut up about the spending of millions of dollars and not seeing any results.
One would think by now people would have seen through this.

That's what a campaign is. You let the people see that you know what their problems are.
You ask that they give their problems to you by voting for you.
You show the voters you know how to fix the problems, how to make their lives better.
In a campaign you give the voters the details on how you will fix the problems,
because you are supposed to know this before getting elected.
Freedom
We have many freedoms - freedoms of speech, freedoms of song,
freedoms of dance. We have the freedom to be intelligent.
There are those who burn our country's flag as if that hurts us,
not understanding that they have done nothing.
You can't burn something that is already a flame.
There are those who pose for pictures of themselves,
our country's flag in a dirty puddle of water,
their foot holding it down, a smile on their face,
trying to look like they've done a superior thing.
For all their education, they evidence the brainwork of simpletons.
Burning a flag, smearing it in a puddle, does nothing to us.
It just shows they worship tokens, often their own socialist tokens,
to the exclusion of any real comprehension.
Our flag.
The red and white stripes are, as others have found, war paint.
This flag will always be against the evils of the world.
Our flag exists because of the flame of Freedom that is in us.
It was in those who came before us; it will be in those who come after.
It cannot be extinguished; it is always reborn.
The designers of our flag must have subconsciously sensed
they found the right design, when they set bright pointed stars
on the dark blue background, a constellation of the founding states.
This flag should always be flown high, so all can look up to see the
field of stars, the display of Freedom; that it should cover the earth like the night sky.
What is our American Flag? It is a signal, a lighthouse beacon.
Whether a banner draped quietly, or wild colors flourishing in the wind,
beneath this flag lives Freedom.
The Declaration of Independence, the Constitution, the Bill of Rights,
are manifestations of this that belongs to us.
Freedom, the innate right to individual liberty, is the superpower that is ours.
freedoms of dance. We have the freedom to be intelligent.
There are those who burn our country's flag as if that hurts us,
not understanding that they have done nothing.
You can't burn something that is already a flame.
There are those who pose for pictures of themselves,
our country's flag in a dirty puddle of water,
their foot holding it down, a smile on their face,
trying to look like they've done a superior thing.
For all their education, they evidence the brainwork of simpletons.
Burning a flag, smearing it in a puddle, does nothing to us.
It just shows they worship tokens, often their own socialist tokens,
to the exclusion of any real comprehension.
